Website Terms of Use
Last updated 2026-10-14
These terms govern your use of proberun.com (the "site"), operated by ProbeRun LLC, a New Jersey limited liability company ("ProbeRun", "we", "us"). By using the site, you agree to these terms. If you do not agree, do not use the site.
What these terms cover
These terms cover the website only.
The ProbeRun software is licensed separately. The proberun command-line tool, its libraries and the GitHub Action are licensed under the Apache License, Version 2.0. The self-hosted ProbeRun server and dashboard are source-available under the Functional Source License, Version 1.1, Apache 2.0 Future License (FSL-1.1-ALv2); each version becomes available under the Apache License, Version 2.0 two years after its release. Your use of that software is governed by its license, not by these terms. Any hosted ProbeRun service or early access program will have its own terms, which you will see before you use it.
If these terms conflict with a software license or a separate written agreement with ProbeRun, the license or agreement controls for its subject.
Using the site
You may view and use the site for your own information and to contact us. You agree not to:
- break the law, or use the site to harm others
- try to gain unauthorized access to the site or the systems behind it
- disrupt, overload, or attack the site, or bypass its spam protection
- submit false information, spam, or automated submissions through the form
- submit malware, or content you have no right to share
- scrape the site in a way that burdens it
We may block access to the site for anyone who breaks these rules.
Early access requests
Submitting the early access form does not create an account, a contract for any service, or any promise that we will invite you, reply by a certain time, or offer a product on any terms. We decide who to invite.
How we handle the information you submit is described in our Privacy Policy.
What you send us
You keep ownership of what you write in the form or in email. You give ProbeRun permission to store and use it to reply to you and run early access.
If you send us ideas or feedback about ProbeRun, we may use them without any obligation to you. Do not send us anything confidential. We do not treat form submissions or unsolicited emails as confidential information.
Our content and name
The site's text, design, graphics, and screenshots belong to ProbeRun LLC or its licensors and are protected by copyright. You may quote or link to the site. Do not copy the site as a whole or present its content as your own.
"ProbeRun" and the ProbeRun logo are trademarks of ProbeRun LLC. Neither software license grants rights to use them. Do not use them in a way that suggests we endorse or are affiliated with you, your product, or a fork of our software.
Links to other sites
The site links to other sites, including GitHub and the Python Package Index. We do not control those sites and are not responsible for their content or practices. Their own terms and policies apply.
No warranty
The site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the site will be available, error-free, or secure. Content on the site, including examples, commands, and descriptions of features, is for general information and may be out of date.
Limitation of liability
To the fullest extent the law allows, ProbeRun LLC and its members, managers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the site or these terms, even if we were told such damages were possible.
To the fullest extent the law allows, our total liability for any claim arising from or related to the site or these terms is limited to one hundred US dollars (US$100).
Indemnity
If you use the site in breach of these terms or the law, and a third party makes a claim against ProbeRun as a result, you agree to cover ProbeRun's reasonable losses and costs from that claim, including reasonable legal fees.
Governing law and disputes
These terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws rules. Any dispute arising from or related to the site or these terms will be brought only in the state or federal courts located in New Jersey, and you and ProbeRun consent to their jurisdiction. If you are a consumer in a country whose law gives you the right to bring a claim in your home courts or under your home law, this section does not remove that right.
Changes
We may change these terms. When we do, we will update the date at the top. Changes apply from that date. If you keep using the site after a change, the new terms apply to you.
General
If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term right away, we have not given up the right to enforce it later. You may not transfer your rights under these terms. We may transfer ours to a successor. These terms and the Privacy Policy are the entire agreement between you and ProbeRun about the site.
